September hearing set for Utah teacher accused of sex with students

A former Davis High School English teacher accused of having sexual relationships with two teenage boys will have a preliminary hearing in September. Brianne Altice, charged in Farmington’s 2nd District Court with four counts of first-degree felony rape and two counts of first-degree felony forcible sodomy, made a brief appearance in court Friday where a Sept. 19 preliminary hearing date was set.

September’s preliminary hearing will focus on the second boy’s allegations. At the hearing, prosecutors will present evidence and testimony, and a judge will then decide whether there is probable cause for Altice to stand trial on one count of rape and one count of forcible sodomy.​

Preliminary hearing scheduled for Utah teacher accused of sex with students

When asked Friday to describe his relationship with Brianne Altice, the teenage boy said she was his "teacher with benefits." ... After hearing testimony from the teen, Judge John Morris ruled there was probable cause for Altice to stand trial on one count of rape and one count of forcible sodomy.

Deputy Davis County Attorney Cristina Ortega also asked the judge to add more charges to Altice’s case after hearing the teen’s testimony: three counts of forcible sexual abuse, all second-degree felonies. The judge granted the request, and now the former teacher faces nine felony charges.

A Utah teacher already charged with raping a 16-year-old student will stand trial on even more rape charges after a second teen boy testified that she had sex with him, too. Brianne Altice was already set to stand trial for four felony rape and sodomy charges on a 16-year-old boy.


But after a Friday hearing where a second victim called her a "teacher with benefits," a Farmington judge added five extra charges to her upcoming trial, the Salt Lake Tribune reported. She now faces nine felony charges: three counts of rape and one charge of sodomy for her first victim and one count of rape, one count of sodomy and three counts of forcible sexual abuse for her second.​

Altice has pleaded not guilty to all counts. Her attorney Ed Brass argued she did not use her position as a teacher to persuade the teen into having a sexual relationship. He says she succumbed to the student's frequent flirting. Under Utah law, a victim cannot consent to sex if the other person is in a position of special trust.

But Brass has asked the judge to not allow those statements at her trial, arguing that she was intimidated by the eight to 10 male officers who came to her home last October to interview her about the allegations. Brass argued that the officers would not let her care for children, call an attorney or use the restroom for nearly four hours as they questioned her. "Her statements were coerced and involuntary and were taken in violation of her so-called Miranda rights," Brass wrote in court papers. "The evidence she provided was the product of that tainted statement."​

A former Davis High School teacher already awaiting trial for allegedly having sex with two teenage boys has been charged again with unlawful sexual activity with a minor while out on bail. But defense attorney Ed Brass says the case filed Tuesday in Farmington's 2nd District Court against his client, Brianne Land Altice, 35, does not constitute a new victim.

Altice, who used to teach English at Davis High, was originally charged in December 2013. In December 2014, prosecutors amended the original charge to include a third alleged victim. But because the activity with the third teen allegedly happened when Altice was no longer a teacher, prosecutors have now decided to file it as a separate case.​

Brianne Altice ... was initially arrested in October 2013 after a then 16-year-old boy told police they'd had multiple sexual encounters, according to The Salt Lake Tribune.

A second boy came forward last year. He described Altice as a "teacher with benefits" and said that they had a relationship between April and June of 2013 that eventually led to sex at the boy's Farmington home, the Tribune reports.

Altice, 35, was later accused of raping a third boy, according to Reuters. Altogether, she faced 10 felony charges, including five counts of first-degree felony rape, two counts of first-degree felony forcible sodomy and three counts of second-degree felony forcible sexual abuse, according to the Tribune.

But on Wednesday, she was arrested again after one of the three boys from the first case accused her of having sex with him after she'd already been arrested for raping him and the two others. She also allegedly sent him "a text message with a photograph of her bare breasts," according to court documents obtained by the Deseret News.​
