Melody Carter-McCabe faces a total of nine felony counts of unlawful sex with the boy, who was 15 years old when the nearly yearlong relationship began in September 2010, according to a Merced County sheriff's report. The charges were filed Friday afternoon in Merced County Superior Court. The Merced resident and mother of a 6-year-old was expressionless as court bailiffs led her away in handcuffs. She pleaded not guilty to all of the charges. When the relationship began, the report says, Carter-McCabe was 25. The relationship allegedly lasted until August 2011. Prosecutors say Carter-McCabe could spend up to 12 years in prison if convicted of all charges. The Sheriff's Department launched its investigation in March after rumors began circulating at the school and staff notified law enforcement, said Chief Deputy District Attorney Rob Carroll.

The paper reports the student began “hanging out” at his teacher’s house, and the two would do yardwork together. The boy eventually leaned in to kiss his teacher, which led to a month of “making out,” the newspaper said. The pair began having sex about November 2010, according to the sheriff’s report cited by the Sun-Star.

The boy's father said Monday his family is considering suing the district because it should take some responsibility for the teacher's actions. "There were a lot of rumors going around school. Someone should have known something was going on," the father said. His name is being withheld to protect the identity of his son, the alleged victim in the sex abuse case. The father said he had no idea about the alleged relationship between his son and the teacher until March of this year, when he was notified by school officials. The boy's father said he's never spoken to [Melody] Carter-McCabe and had seen her only in passing at the school and at FFA-related events. The father said he had no idea his son had been spending time at her Atwater home. On those days, the boy said he was either with friends or at FFA events, the father said. The boy took the breakup of the relationship particularly hard in August. The father said he noticed something was wrong because his son's grades started going down. He also began to lose interest in sports and extracurricular activities. The father said the boy's mother, from whom he is divorced, also is taking the case hard.

An agriculture teacher and mother has been accused of having a yearlong affair with a 15-year-old student she was supposed to be mentoring. Melody Carter-McCabe began the affair with the teen when he offered to help out at the 27-year-old's home with chores. The teen told police he kissed the teacher and two weeks later they began having sex. During questioning, the student told detectives that Carter-McCabe had a purple sex toy that she allowed him to use on her. Detectives found the sex toy wrapped in a white sock in a nightstand at the teacher's home in Merced, California. The student also showed photographs of a woman in her underwear on his cell phone and identified her as Carter-McCabe. He described specific details about her body, including that she has a tattoo of a Japanese water symbol on her ankle. Police with Merced County Sheriff's Office launched an investigation in March after rumours began circulating at Livingston High School where Carter-McCabe worked as a agriculture teacher.

Melody Carter-McCabe sat in jail in a yellow jumpsuit and listened while a Merced County judge continued her case until next week. Court documents state the entire investigation started at Livingston High School when a principal called the sheriff's department -- rumors were running rampant about the teacher and one of her FFA students ... Deputies found pornographic pictures of the teacher on the teen's phone. A search of her house matched specific descriptions the boy had given police. They even discovered love letters, they searched the teacher's room at Livingston High, and after seizing her computer, phone and those letters, they charged McCabe with nine counts of unlawful sex. The Livingston School superintendent tells Action News the teacher is on paid administrative leave.

However Monday, after McCabe pled no contest to the charges, a judge sentenced the former educator to five months in the Merced County jail. She is scheduled to report to the jail on Thursday to start her detainment and will be given credit for any time she’s already served leading up to the sentencing. After release, McCabe will be under a five year felony probation but will not have to register as a sexual offender.

ABC Local KFSN: Ex-Livingston HS teacher sentenced for sex with student (Mar 25 2013)

A judge sentenced Melody Carter McCabe to jail for having sex with one of her male students after she pleaded no contest in a courtroom Monday morning. A judge sentenced the former Livingston High School teacher to five months in the Merced County jail. McCabe will also serve five years felony probation but won't have to register as a sex offender. She is scheduled to report to jail on May 28th and will get credit for the week she's already spent.
