According to the May 20, 2014 report, the teacher “conducted a romantic relationship involving sexual conduct” with a 16-year old boy.

The report states that “the contact between the victim and suspect initiated at the San Simon High School in a student/teacher relationship, but moved into a personal relationship.” “They're interpersonal contacts occurred primarily between San Simon and Bowie, on the Frontage Road (Olga Road) in a vehicle.” The report goes onto say that these “incidents of consensual contact” occurred over a 12-month period, but the victim told deputies that sex (oral, no intercourse) begin this year. “The multiple contacts between the victim and suspect were facilitated and witnessed by two of the victim's schoolmates/friends,” it said.

Former area teacher arrested on sex charges

A former San Simon School teacher, charged with having sexual conduct with a former student, pleaded not guilty Monday in Cochise County Superior Court Division Five. Marie Ellen Donaldson, 35, was indicted Thursday, Jan. 15 on 10 counts of engaging in oral sexual contact with a minor, between December 2013 and May 2014. She had been arrested the evening of Tuesday, Jan. 20, in Idaho, and was released Wednesday on a $25,000 bond.

Initial contact was made with the teacher, who was placed on administrative leave as the investigation continues, Capas said. When interviewed at home several days later, Donaldson denied any inappropriate contact with the student. She said he had provided him with her cellphone number to assist him with homework, and he expressed interest in a physical relationship, but she never engaged in that kind of activity with him. Later, warrants were obtained for the cellphones of both Donaldson and the victim for analysis.

In a statement issued May 21, 2014, then-San Simon High School Principal Jonathan Truschke said that a staff member notified him May 15 that “they had made a mandatory report to law enforcement based on information they had received from a community member about a sexually inappropriate voice mail message,” which a San Simon high school teacher had left for a student.

    GUILTY
BISBEE — A former San Simon high school teacher has pleaded guilty to two counts of engaging in oral sex with a minor, according to a plea agreement filed Friday in Cochise County Superior Court.
Marie Ellen Donaldson, 35, changed her plea following a settlement conference Friday morning, according to court documents.
Donaldson was indicted Jan. 15 on 10 counts of engaging in oral sex with a minor. The charges were all Class 2 felonies, which can receive sentences of five years in prison or more.
According to the indictment, the incidents occurred between December 2013 and May 2014, when Donaldson was a teacher at the school and the victim was 16 years old.

According to the plea agreement, Donaldson agreed to plead guilty to two lesser degree felony charges — and could receive probation instead of jail time.
Count one of the charges, attempting to engage in oral sexual contact with a person under 18 years old, is a Class 3 felony, and Donaldson could be sentenced to between two and more than eight years in prison. Count two, engaging in oral sexual contact with a person under the age of 18, is a Class 6 designated felony, and Donaldson could be sentenced to between four months and two years on that charge.
But according to the plea, Donaldson is eligible for probation on both charges, at the discretion of the court.
If she were granted probation, it would be either standard supervised or intensive, and could be for life on the first charge, and three years on the second charge.
Even if she is granted probation, Donaldson could be sentenced to up to one year in county jail. The plea agreement stipulates a 30-day jail sentence, which will be deferred as long as Donaldson complies with the condition of her probation. She can be ordered to serve up to 14 days in jail at a time of the 30-day sentence if she violates her probation.
Donaldson also will have to surrender any teaching licenses she holds and not apply for any in the future, and will be required to register as a sex offender.
According to Deputy County Attorney Lori Zucco, the judge deferred accepting Donaldson’s change of plea until the time of sentencing, which is set for 3 p.m., Monday, Aug. 17 in Division 5.
