    The charges were dropped on technicalities. The law on which her charges were bases was ruled too broad & unconstitutional. Although the Texas legislature addressed the issue and revised the statute, the changes cannot be applied retroactively.

    [Kathryn Maples] resigned April 8 from her job at Ector County Independent School District amid an investigation that she was having an inappropriate relationship with a 17-year-old student. An Ector County grand jury indicted Maples Monday on three charges of improper relationship between an educator and student, according to a news release issued by the Ector County District Attorney’s Office. The three counts include sending sexually explicit pictures as well as online solicitation of a student, according to the release.

    [District Attorney Bobby] Bland said in an interview that his office received the file the middle of May, a couple weeks after ECISD police said they would not be charging Maples. First he called ECISD police and asked them about the case, Bland said. After ECISD police gave him some information, Bland said he asked them to file the case with his office ... “We were able to develop new evidence,” he said. “Sometimes we have tools available that they do not.” Two of the charges are specific to pictures in text messages, Bland said, and the third charge is accusing inappropriate online solicitation.

    Kathryn Maples was arrested early Wednesday on the felony charge. She was released shortly thereafter on $60,000 bond. She 28-year-old history teacher also coached swimming and diving. An Ector County grand jury indicted her Monday on three counts of an improper relationship between an educator and student.

    Odessa American: Permian swim coach resigns amid investigation (April 8 2013)

    Kathryn Maples, the head coach of the Permian girls swimming and diving team and a history teacher, offered that resignation and was under investigation by Ector County ISD administrators and police, spokesman Mike Adkins said ... Adkins said the investigation into the relationship between Maples and a 17-year-old boy had begun before Maples turned in her resignation, but he was not sure when the investigation was started.

    [Kathryn] Maples, 28, is being investigated for allegedly having an improper relationship with a 17-year-old boy ... Maples joined the district in June 2012 and was most recently a history teacher and the girls swimming and diving team head coach. According to a Midland County Courthouse court coordinator, attorneys for Maples and her husband reached a temporary divorce settlement in a hearing Wednesday morning.

According to the indictment, the inappropriate relationship happened via text message over a short period in January. [Kathryn] Maples allegedly sent a picture of her genitals to a 17-year-old student. The former history teacher and swim coach allegedly sent a photo of her breasts a few days later. The indictment also said Maples sent explicit texts messages to the student describing oral sex and sexual intercourse with him.

    And within five days of each other last year, two female teachers, Kathryn Maples and April Collins, both then 28, resigned and were indicted on charges of having an improper relationship between educator and student.

    Attorney: Young’s acquittal may affect teacher case

    April Collins and Kathryn Maples, who both were employed at Permian as a trainer and a swim coach, respectively, were accused in June 2013 of having improper relationships with students by text message and Internet messages. Alisha Carrasco Knighten, a P.E. coach at Bonham Junior High and softball coach at Permian, was arrested in May on the same charge, although the accusation against Knighten from police was that she had sex with an 18-year-old female student. With Young’s acquittal, one defense attorney said that may affect the other cases.

    Filing looks to quash indictment against Maples

    The motion, filed Tuesday, also cites the most recent ruling by the Eastland-based 11th Court of Appeals that ruled to allow the dismissal of three of the four counts against former Permian High School trainer April Collins.

    In the motion for Kathryn Maples, attorney David Rogers cites the Nov. 5 ruling in which the state appeals court repealed three of the four indictments against Collins.

    According to the opinion, three of the four counts against Collins, which reference online solicitation of a minor, should be dismissed after the section of the Texas Penal Code that dealt with the charge had previously been ruled unconstitutional under the First Amendment.

    The opinion states the original statute Collins was charged under was too broad at the time and, despite an update to the section by the Texas Legislature this year, the previous version of the section was the law local prosecutors were referencing when she was indicted.
