In the motion for Kathryn Maples, attorney David Rogers cites the Nov. 5 ruling in which the state appeals court repealed three of the four indictments against Collins. According to the opinion, three of the four counts against Collins, which reference online solicitation of a minor, should be dismissed after the section of the Texas Penal Code that dealt with the charge had previously been ruled unconstitutional under the First Amendment.
