Carter County Sheriff’s Deputy David Munsey said he was called to investigate a report of an alleged sexual assault on a student at Unaka High School on the morning of Nov. 7. He said two students had complained that Fair, while working as a substitute teacher, had made sexual comments both verbally and electronically through his cell phone to the two girls. Munsey said school officials interviewed both the students and the substitute teacher. Munsey said the officials determined Fair had touched, then “rubbed” the buttocks of one of the girls as she was leaving the classroom. The girl went immediately to the school office to report the incident. Munsey arrested Fair. During a search, Munsey said Fair was found in possession of a red container holding a tablet believed to be Lortab. A white pen was also found which Munsey said contained a substance that appeared to be drug residue. Two $1 bills were found in Fair’s pocket that Munsey said contained drug residue. Background: Unaka High School substitute charged in sexual assault of student 7 Nov 2014 According to a Carter County Sheriff's Office news release, a Unaka High School school resource officer received information that substitute Joshua Michael Fair, 24, sexually assaulted a student. Following an investigation, Fair was arrested and charged with offense of sexual assault by an authority figure. According to the release, during the arrest deputies found a small quantity of schedule II drugs and two knives on his person. Background: School system fires teacher accused of student abuse 12 Nov 2014 Fair was arrested on Friday by officers of the Carter County Sheriff’s Department and charged with sexual assault by an authority figure, possession of Schedule II drugs, violation of the drug-free school zone and two counts of possession of weapons on school property. An investigation beganon Friday when CCSD Deputy David Munsey, the school resource officer at Unaka High School, received information Fair sexually assaulted a student at the school during on Friday. According to a warrant written by Munsey, two girls reported to school officials that Fair had made sexual comments to them, both verbally and electronically using a note pad app on his phone. One of the girls also reported that Fair had touched her inappropriately as she left the classroom. Substitute teacher pleads to lesser charge A former substitute teacher who had been charged with sexual battery by an authority figure pleaded to a lesser charge in Carter County Criminal Court on Tuesday. Joshua Michael Fair, 26, pleaded guilty to simple assault/provocative offensive touching. He was sentenced to six months supervised probation. Judge Stacy Street also ordered Fair to have no contact with the victim. The original charge was a class C felony The lesser charge is a class B misdemeanor.
