    Teacher charged in Eastpointe pool drowning faces preliminary exam today

    ... an Eastpointe judge bound over for trial a substitute teacher charged with manslaughter in the drowning of her son, KeAir, in the East Detroit High School pool ... Three students who were in the pool that day testified Sails was the first adult in the water, but first went into the locker room area to remove some of his clothes. Once he got into the pool, they testified, he said: “It’s too deep.” KeAir, who was at the bottom of the deep end of the pool, was pulled lifeless out of the water by an acting assistant principal who jumped into the water fully clothed. KeAir — who did not know how to swim, according to his family — died after several days on life support.

    Second teacher could have rescued boy drowning in East Detroit pool

    Johnathan Sails was bound over to Macomb County Circuit Court on a charge of involuntary manslaughter by Judge Carl Gerds following a preliminary examination Thursday in 38th District Court in Eastpointe. Sails faces a May 27 circuit court arraignment. Gerds said it was legally probable Sails failed to show ordinary care or diligence when KeAir Swift, a 14-year-old student in his swimming class, jumped off a diving board into the deep end of the pool and had to be rescued minutes later from the pool’s bottom by an administrator. KeAir died from his injuries a few days later.

    Testimony Begins In Trial For Swim Teacher Charged In Student’s Drowning Death

    During testimony in Eastpointe District Court, physical education teacher Dave Zauner said he was concerned about Sails credentials, and his ability to keep the kids safe, given his conduct in another gym class. “I just felt the pool, we know there can be injuries. It’s a serious place to be and a serious place to teach, and you better be on your game,” Zauner said. “I talked to the department head…and I was like, ‘Hey, we gotta get Johnathan Sails out of the pool.'” Zauner said the department head assured him that Sails was certified to teach swim class, although prosecutors say Sails misrepresented his Red Cross training when he applied for the job.


    Another phys ed teacher, James Reed, testified that Sails would often be texting on his cell phone and failed to maintain order during classes he described as chaotic. Authorities said Sails went to change clothes in the locker room before jumping in to help KeAir, and was not poolside as the student struggled in the water.

    Teacher who pulled boy from pool: District retaliated

    In what otherwise was a tragic story, David Zauner was hailed as a hero when he jumped into the East Detroit High School pool in his dress clothes and pulled the near-lifeless body of student KeAir Swift from the bottom last autumn. Now Zauner, a veteran teacher and basketball coach, is suing East Detroit Public Schools and assistant principal and athletic director John Rizzo, saying they retaliated against him because he cooperated with police during an investigation into the Nov. 8 incident.

    Teacher wants charges in school pool drowning dropped

    [Johnathan] Sails' attorney, Robert Leonetti, filed a motion Tuesday in Macomb County Circuit Court asking for dismissal. "Our position is that factually and legally, it doesn't rise to the level of gross negligence on Johnathan's part," Leonetti said Thursday, after a scheduled pretrial conference in the case was adjourned.

    Authorities said Sails lied about having lifeguard certification. Witnesses testified in district court that Sails was sitting in the bleachers, fully clothed, during the class. They said he at first hesitated, then went into a changing area to remove his clothes, and once he jumped into the water, said it was too deep to rescue the boy.

    Former substitute teacher seeks dismissal of charge for pool drowning

    A former substitute teacher charged with manslaughter in the drowning of an East Detroit High School student blames a newly hired full-time teacher for the death. Robert Leonetti, the attorney for Johnathan Sails, on Monday asked Judge Peter J. Maceroni to dismiss the involuntary manslaughter charge against Sails for last November’s drowning of KeAir Swift in the high school pool during swim class.
