    Teacher gets probation for relationship with student


    Yacobozzi will have to register as a sex offender every 90 days for the rest of her life, Judge Mark Betleski said. She also is required to do 100 hours of community service. Betleski said that she is not allowed to establish residence 1,000 feet from a school. She also cannot have any contact with the victim.
     
  6. Registering every 90 days for life is excessive, she is 28 years old and fell victim to bad judgement with a 17 year old boy more than willing to go the distance. The Judge was to extreme on this case.

    A North Ridgeville High School teacher is charged with two counts of sexual battery stemming from incidents involving a 17-year-old male student, according to police. Constance Yacobozzi, 28, of Elyria, was arrested at the Lorain County jail March 16 and released on bond, North Ridgeville Police Capt. Marti Garrow said. A Lorain County grand jury returned an indictment against the teacher March 14. An indictment is a formal criminal charge. “She was indicted on two counts, which means that our investigation led us to believe there were two occurrences of sexual activity,” Garrow said ... The accused teacher admitted texting two photos to a student, including one of herself in a bikini top, according to police. She was fully clothed in both pictures. She denied any sexual activity took place, police said at the time.

    The school board during a special 7 a.m. meeting March 29 accepted the resignation of a high school science teacher accused of sexual battery involving a 17-year-old male student. Constance Yacobozzi, 28, submitted a letter of resignation to Superintendent Larry Brown in which she wrote that her resignation was effective March 22.

    The North Ridgeville Board of Education voted unanimously this morning to accept the resignation of Constance Yacobozzi, a high school teacher indicted for sexual battery involving a student earlier in March, according to Treasurer Biagio Sidoti. The board met at 7 a.m. for the purpose of accepting the resignation, Sidoti said.

    Former North Ridgeville High School teacher Constance Yacobozzi pleaded guilty Monday to two counts of sexual battery for having a sexual relationship with a 17-year-old male student. Lorain County Common Pleas Judge Mark Betleski said he told Yacobozzi that she will likely receive probation when she is sentenced later this year. That is contingent on a report on her past coming back without any prior criminal convictions, the judge said ... Yacobozzi told police during an interview that she sent two photos of herself, including one of herself in a bikini, to a student, and acknowledged that she had “inappropriate and flirtatious” conversations with a least one student dating back to last summer. Thos conversations took place mostly through text messages, police have said.

    A former North Ridgeville High School teacher pleaded guilty yesterday to two counts of sexual battery involving a student. Constance Yacobozzi, 28, of Elyria, admitted to school officials in November 2011 that she had texted photos of herself wearing a bikini top to the 17-year-old student, as well as having inappropriate and flirtatious conversation with him via text messaging. A sexual offender classification hearing is scheduled to immediately precede sentencing, a date for which has yet to be set.

    Former North Ridgeville High School teacher Constance Yacobozzi will be sentenced in about two months on two counts of sexual battery after pleading guilty June 4 in Lorain County Common Pleas Court. Police and prosecutors accused Yacobozzi, 29, of Elyria, of sexual activity in late 2011 with a male student, then 17. Judge Mark Betleski is expected to sentence Yacobozzi once the county completes a pre-sentence investigation, a court spokeswoman said. Yacobozzi’s defense attorney, Richard Lillie, of Cleveland, said he would ask the judge to place his client on probation. “She’s a first-time offender,” Lillie said. “This was just a mistake in judgment, and we’re hopeful and expectant that she will be able to get probation.”

That’s the last place that I would think I would ever have to worry about something like this happening,” said the North Ridgeville mother, who we are only identifying by her first name of Margie, in order to protect the identity of her son who is the victim of a sex crime ... She was targeting these young boys and she wanted to have a sexual relationship with one of them ... I’m just a little surprised she’s kind of getting off with a slap on the wrist. You know community service and probation. I don’t really understand it. She had sex with an underage student of hers, ... He’s not the only one she was texting. The picture that they keep talking about wasn’t even sent to my son it was sent to a whole another kid. So, I feel like she was preying on these kids ... She was pretty smooth, the way she approached things. She gained his confidence. She took him places, without my knowledge, she took him places, she went and had coffee with him, she befriended him. Just the whole thing, she knew what she was doing,” Margie said.

But the boy’s mother said Yacobozzi deserved prison time. “I sent my son to school to learn, not to have sexual relations with a teacher,” she said.

    Former North Ridgeville High School teacher Constance Yacobozzi avoided prison when she was sentenced Monday for having sexual relations with a 17-year-old male student. The boy’s mother had urged Lorain County Common Pleas Judge Mark Betleski to lock her up, arguing that if a male teacher had been caught with a female student, he would have received a prison term ... But Betleski said that his review of the sentencing factors in the case and Yacobozzi’s lack of a criminal record led him to put her on probation for three years and order her to perform community service. If she violates the terms of her probation, the judge said he will send her to prison for four years. Yacobozzi, who pleaded guilty to two counts of sexual battery in June, also was declared to be the highest level of sex offender and must register every 90 days for the rest of her life.

    Former North Ridgeville High School teacher Constance Yacobozzi received three years’ probation during a sentencing hearing Monday on two counts of sexual battery. Lorain County Common Pleas Judge Mark Betleski imposed the sentence and said she would need to register as a sex offender for the remainder of her life. She also will need to perform 100 hours of community service ... Betleski, in imposing sentencing, said he believed probation was appropriate based on the results of a pre-sentencing report. The judge imposed numerous conditions, including that Yacobozzi maintain employment and have no association with the victim.

    I agree, especially since there was no charge of actual sex, and the raunchiest photo mentioned was no spicier than what you'd see on beach.

    However, I've quit being surprised by the outcomes of these cases.

    I went to this high school and had Mrs. Yaco as a Chemistry teacher in my sophomore year, two years before this happened. I happen to know the boy in question, and have confirmation that much more than sexting went on with them, as well as with at least four more boys, all of which were under eighteen when they were involved. If this was a male teacher involved with a female student, the town would be calling the firing squad. Willingness to participate doesn't make it any more correct, nor any less illegal. This punishment was justified.
