    Calif. appeals court overturns youthful conviction for resisting arrest

    Seventeen-year-old Frank A. was standing in a hallway of a Redwood City high school awaiting a disciplinary hearing when a police officer “encouraged” him to put down his cell phone and go to the hearing and put his hand on the youth’s back. Frank spun around, lightly brushed the officer’s shoulder, and soon thereafter was charged with and convicted of battery and resisting arrest.     Appeals court blasts police, prosecutors for arrest at Peninsula high school

    Appeals court justices sharply criticized San Mateo County prosecutors and a Redwood City school resource officer this week for charging a 17-year-old with battery and resisting arrest after he “lightly brushed” the officer’s hand in a hallway. In a unanimous opinion overturning a juvenile court’s convictions, the appellate court wrote that the officer needlessly escalated the April 2017 interaction with the teenager, who was being taken to a vice principal’s office after skipping class.
