(1) Who are you, and why do you care? The emails that I've recently received indicate that in all likelihood you are not Daniel James Hines. (2) Learn to type in upper & lower case like a normal person. Shouting at me in all caps gets you nowhere. (3) The fact that links are broken means nothing. Media routinely age out current articles by removing them and/or relocating them to paid archives. (4) This is a discussion forum. If you actually have documentation that the story was "proven to be a misunderstanding and all charges were dropped", upload the evidence & post it here. A normal nolle prosequi by a prosecutor doesn't really say that anything was "proven to be a misunderstanding", but lacking any evidence to the contrary, I will usually remove posts where charges have been dropped, approximately 1-3 months after such supporting information has been posted. After all, our readers deserve to hear the conclusion to the story. (5) Understand that what is known as a "deferred adjudication" or "pretrial diversion" is in essence a guilty plea with a provision that the courts eventually will hide the record of the conviction. In such cases the story will not be removed here.
Hi, this is Daniel Hines the one you are referring to in this post. I want to first apologize for my wife writing in all Caps and I am sorry she came off that way she was simply just upset and did not mean it. I am writing to ask that you remove this and any forum associated with my name due to the fact that I was acquitted of all charges and was not convicted. Also the story in the forum is false and portrays in incorrect situation. To answer some of your other points you indicated are as followed. For number (3) the links are not dead just simply because they removed them, they are not there because I contacted there legal departments and sent them the proper documents that showed I was cleared of any wrongdoing and they kindly removed the page from there site and contacted Google to get them to remove it from their server as well. Both The Daily Tribune and Patch.com were understanding and helpful in the process for me and I hope you will do the same. I do agree that your readers need to hear the ending of the story and I understand your site is to promote awareness of individuals that others should watch out for, but in my case I was not convicted nor did I have to enter a guilty plea. You are correct in a deferred adjudication you have to enter a guilty plea as Deferred adjudication begins after a defendant has pled guilty or nolo contendere. But that is not the case for pre-trail diversion. Pretrial diversion removes a defendant from prosecution prior to a guilty or nolo contendere (no contest) plea. I will be happy to send you the documents that I recieved from the district attorney's office to show you the truth of this matter. I hope that we can resolve this manner civilly and not have to get legal teams involved. Just so you know I have contacted my lawyer to alert them I was writing you and just incase anything were to go wrong. Thank you for your time and I look forward to hearing from you soon.
