Another case of lazy stupid pigs busting someone without verifying their information. It's to the girl's credit that she would not discuss anything directly with the police. She's been raised well! Always have a lawyer!

APS employee’s mistake left innocent teen jailed for murder

When a detective asked for help identifying a murder suspect from a Facebook photo, an Albuquerque Public Schools employee obliged. But that employee picked the wrong girl. The case of mistaken identity left an Albuquerque High student in jail for a week — charged with a murder she played no part in. Making matters worse for 17-year-old Gisell Estrada, the criminal complaint was sealed, which Estrada’s defense attorney says left him blind to the allegations against her. Police had said Estrada and her friends set up the robbery of a 21-year-old man in July that ended with his death in ...

Public defenders there for wrongfully accused teen

In his Dec. 15 guest column, “Who’s there for Gisell?,” retired Albuquerque Police Department Sgt. Dan Klein addresses the tragic case of Gisell Estrada, the 17-year-old girl who was misidentified by APD, arrested and jailed for six days for a crime she did not commit or know anything about. The headline of the column asks a critical question: “Who’s there for Gisell?” And I can tell you this: Her public defenders at the state Law Offices of the Public Defender were there for her every step of the way. Gisell was targeted by police after an employee at her school ...

17-year-old girl who was wrongly arrested and charged with murder files lawsuit

A 17-year-old girl who was wrongly arrested, falsely charged with murder, then put in jail is filing a lawsuit against the city of Albuquerque, the police department, and Albuquerque Public Schools. Gisell Estrada was involved in a case of mistaken identity last year. APD arrested her for armed robbery and first degree murder. She was charged as an adult and spent a week and jail. Estrada was released after APD arrested a different person. The lawsuit, which is expected to be filed Thursday morning by the ACLU and a private law firm, is considering claims for false arrest, false imprisonment, ...

ACLU sues city in mistaken identity arrest of high school student

Gisell Estrada is shy and soft-spoken. The 18-year-old doesn’t like large groups and ate lunch, every day, with her teacher in a classroom at Albuquerque High. She says she had never been in any sort of trouble. The arrest came at the behest of Albuquerque police Detective Jessie Carter and a botched identification by a school administrator based on a Facebook photo of the real suspect — 18-year-old Alexis Pina — and nothing else. But, on Nov. 8, 2019, Estrada was wrongfully arrested in the killing of Calvin Kelly, a 21-year-old shot to death during an alleged robbery attempt in ...
