    A former Blount County teacher set to go to trial Tuesday on a charge that he had sexual contact with a student, whom he later married, is challenging the constitutionality of the state's law banning school employee sex with students under the age of 19. Attorneys for Matthew Wester on Sunday filed a challenge to the constitutionality of the school employee law, and requested dismissal of the charge against him, according to court records.     The challenge filed Sunday is similar to two others filed recently in Alabama. Earlier this month, attorneys for Carrie Cabri Witt filed a challenge to the constitutionality of the school employee law. Witt, 42, a history, psychology and social studies teacher at Decatur High School, was arrested in March for having a sexual relationship with two male students, both of whom were 17 at the time of the alleged acts. She also coached girls' golf and junior varsity cheerleaders, according to the school's website.


    In March, attorneys for Joe Bradley Petrey, 28, of Northport, filed a similar challenge. Petrey was charged in August under the school employee sex law for having sex with an 18-year-old female student. The motions in all three cases say teachers' 14th Amendment equal protection rights to not be treated differently than other classes of citizens is being violated by the state law enacted by the Alabama Legislature in 2010.
