    Montana judge suspended over rape comments opposes discipline

    A Montana judge who made disparaging remarks about a teenage sexual assault victim and issued an unusually light sentence to her attacker last year is asking the state's Supreme Court to withdraw his suspension. Judge G. Todd Baugh, who was soundly rebuked when he suggested that the 14-year-old victim of a 2008 sexual assault case was "as much in control of the situation" as her assailant, Casey Rambold, contends in court papers filed Friday that inaccurate news accounts helped lead to his suspension.

    Teacher to be re-sentenced in Montana rape case

    A Montana teacher was sentenced Friday to 10 years in prison in a notorious student rape case that dragged on for years and led to the censure of a judge who partially blamed the victim. Stacey Dean Rambold, 55, was resentenced by a new judge exactly a year after he completed an initial one-month prison term for the crime. Rambold appeared to grimace as Friday's sentence was read by Judge Randal Spaulding. He was then handcuffed and led away by deputies, pausing briefly to exchange words with family as he exited the courtroom.

    Montana Teacher Initially Given 31 Days for Raping Student Is Resentenced

    Stacey Dean Rambold was accused of raping Cherice Moralez, a freshman in his business class at Billings Senior High, in 2007. Moralez committed suicide in 2010, before the case went to trial and before she reached her 17th birthday. The 55-year-old teacher pleaded guilty to sexual intercourse without consent ... On Friday, Judge Randal Spaulding resentenced Rambold, this time to to 15 years in prison, with five years of that suspended, according to a prosecutor in the case. Rambold was then handcuffed in court and taken to Montana State Prison.

    Stacey Dean Rambold has only himself to blame for setting himself up to be retried & resentenced:

    Teacher gets 10 years prison in student rape


    After the death of Moralez, the prosecution's primary witness, Twito's office in 2010 struck a deal with Rambold that initially allowed him to avoid prison altogether. Rambold, however, violated that agreement by having unauthorized visits with relatives' children and entering into a relationship with an adult woman without telling his counselor. As a result, the case was revived and Rambold pleaded guilty.

    Rambold sentenced to 10 years in prison for raping student who later committed suicide

    Michelle Downey was the first to testify. She is a state probation and parole officer who supervises 55 sex offenders, including Rambold. When questioned by Twito, Downey said Rambold should "absolutely" be put back into sex offender treatment. She started using monitoring software on Rambold's cellphone and computer after he sent "flirtatious" text messages. She has monitored his Internet use since November 2013.

    Downey said that Rambold uninstalled the monitoring software, Covenant Eyes, on Friday at 11:42 a.m. He has had two Internet-use violations since then, Downey said. According to Downey, Rambold was apparently searching for "massage parlor" services.

    [County Attorney Scott] Twito described Rambold as a "boundary pusher." He said that Rambold's Internet usage shows he's still pushing boundaries.
