    Destrehan teacher sex case remains set for May trial

    Former Destrehan High School teacher Shelley Dufresne, accused of having sex with a 16-year-old student, appeared in court in Hahnville on Wednesday (Feb. 18) for a status hearing on her case. Her trial is scheduled May 20. Prosecutor Julie Cullen and Dufresne's attorney, Deanne Williams of Luling, met privately with Judge Anne Simon at 29th Judicial District Court, for more than 30 minutes before they set another hearing for April in open court.

    Destrehan teacher accused of threesome with student ‘didn’t have consensual sex’

    WGNO Anchor Jacki Jing spoke with Smith, first saying, “Your client is facing some serious accusations about group sex with a sixteen year old, what do you have to say to that.”

    “She’s not guilty, because the law says in order to have sex with any one it has to be consensual,” Smith responded.

    “Are you insinuating that she didn’t have sex with him?” Jing asked.

    “I said that there was no consensual sex,” said Smith.

    “Can you elaborate on that, what do you mean? ” said Jing.

    “Read between the lines,” said Smith.

    “Are you insinuating that she was raped or forced into something?” said Jing.

    “We could go about this — but in order for a woman — thank God — in this day in age, to have sex with someone that’s perfectly legit she has to know exactly that she’s consenting and wants to have sex and as you know we have cases all over the press now about young girls who don’t seem to realize what happened to them, that’s all I am saying,” said Smith.

    The "I was too drunk to know what was happening" defense has reared it's ugly, yet totally expected head! Either that or he is suggesting Shelley and the boy slipped her some roofies and took advantage of her. We'll see what happens when it's Shelley's turn to face the judge.

    At the end of the day, Respess is still reported to have said that she knew sex was on the agenda when Dufresne asked to drop by with her boy-toy student after his football game. In the Lippert / Ghirelli case, Lippert is being held equally accountable for the statutory rape committed by Ghirelli because she (Lippert) facilitated the sexual act. No matter how her lawyer tries to spin whether or not the sex involving Respess was consensual, at the very least Respess knowingly facilitated and stayed quiet about Dufresne's sexual abuse of this kid. If the DA doesn't press charges against Respess here, it will be a travesty of justice.

    To Respess and Ghirelli I'd say, you really should be a little more careful about your choice of friends. In both cases, they were invited to a table for which they didn't set nor prepare the food. It's unfortunate that at the critical moment when both should have turned away once they understood what their partner in crime had in mind, instead they each decided to sit down and partake of the feast. Nothing absolves them of their responsibility in this regard. NOTHING!

    Shelley Dufresne, teacher in Destrehan High sex case, due back in Jefferson Parish court in May

    As former Destrehan High School teacher Shelley Dufrense awaits her trial in St. Charles Parish, where she's accused of having sex with a 16-year-old student, she must wait longer to learn whether she faces a similar charge in Jefferson Parish. The Jefferson district attorney's office has made no decision on whether or when it will charge Dufresne for allegedly having sex with the same teenager in Kenner. That was the word from the 24th Judicial District Court, where Dufresne had a status hearing on the case Wednesday morning (March 11). A new hearing was set for May 8.

    The legal "dance" continues in the Bayou....It's obvious at this point that Respess has not been charged with any crime because the DA's know she will testify against Dufresne as part of of a possible plea-bargain.

    Former Destrehan High School teacher Shelley Dufresne pleaded guilty to obscenity Thursday (April 9), admitting in court that she had sex with a 16-year-old student. The plea lets her and the student avoid a public trial, and allows her to bypass registering as a sex offender and serving three years in prison. She must spend 90 days at an inpatient mental health facility, serve three years of active probation and pay a $1,000 fine. If she fails to complete the court-approved mental health program by the end of August, she must report to the St. Charles Parish jail Sept. 1 to serve any days for which she has not received credit, Judge Anne Simon said during the plea hearing at the Hahnville courthouse. Dufresne also agreed to surrender her teaching license.

    ... Simon deferred a 3-year prison sentence on the carnal knowledge charge.

    • Shelley Dufresne was arrested in September when a student at the high school she taught at started bragging about sleeping with two teachers

    Well, as somewhat expected, Dufresne gets what amounts to a free pass in the Parish where her father is a judge. How embarrassing to the integrity of our criminal justice system. The District Attorney Joel Chaisson II, who was in court during the plea hearing, released a statement saying, "I want to thank my special prosecutor, Julie Cullen, for her efforts to reach a fair resolution of the case and to secure a felony guilty plea, thereby sparing the juvenile victim in this matter from having to testify at a public trial." Fair? By who's opinion? I'd say she failed miserably in reaching a fair resolution. And I'd venture to say most (including the victims parents who were present in the courtroom) would agree that this plea deal was anything but fair. Several news reports stated the boy's parents were visibly not pleased at all. I know it's a separate case, but this woman enlisted another adult to join in with her ongoing sexual abuse of this kid for god's sake. Mental illness or no, she knew what she was doing, she knew it was wrong, she did it anyways, and she deserves a couple of years in jail to think ab0ut it. But from the perspective of the prosecutor, a guy who will have to present future criminal cases to Dufresne's judge father....I have no doubt he's satisfied with the results.

    Fairness is the furthest thing from this plea agreement. It's laughable that they would even claim it to be so. Lets hope Jefferson Parish prosecutors shows some guts and hold Dufresne (and Respess) accountable in a way that is commensurate with the crimes they committed. Especially Dufresne....she deserves significant jail time.....anything less is a travesty of justice and an embarrassment to our judicial system.

    The priority seems to have been avoiding a trial for the sake of sparing the victim from having to testify (i.e. brag in exquisite detail about how these women lusted after him).....really? I thought the priority was supposed to be something like ensuring a sex offender pay a fair price for the crimes she committed? Someone will have to explain to me how giving her a free pass with no jail time is in the victim's / communities best interests. No doubt the prosecutors would have felt the same had it been their kid....

    Destrehan High School teacher sex case: What's ahead for Shelley Dufresne and Rachel Respess

    Here's what happens next:
    • Waiting on the DA -- The Jefferson Parish district attorney's office has not yet decided whether to charge either woman in the Kenner case. Police booked them with carnal knowledge of a juvenile, indecent behavior with a juvenile and contributing to the delinquency of a juvenile. Respess' attorney, Jeffrey Smith, maintains she is innocent of having "consensual sex" with the student: "You don't have to say no to mean no if you're not able to give true consent. My position on that one night is, Rachel Respess did not have consensual sex with this young man."
    • Respess in court -- Respess' next scheduled court date is a status hearing April 30. She is not required to attend.
    • Dufresne in court -- Dufresne's next scheduled court date on the Kenner case is a May 8 status hearing. She is not required to attend. Her attorney on this case, Jim Williams, would not comment Thursday on her guilty plea in St. Charles Parish.

    Sure enough....the fully expected "I was too inebriated to know what the heck was going on" defense has reared its ugly head. A quote from a recent article in the advocate where Respess's lawyer lays out her defense....according to him she was inebriated before dufresne ever got there and implied the knock on the door was a surprised to her....wonder how much Respess is paying her lawyer to paint her as a liquered up lush who will hop into bed with anyone she has a couple of drinks in her?

    "As for Respess, Smith made several points that likely will be part of her defense if she’s charged: He said she was “very intoxicated” the night of the alleged three-way sexual encounter last September, that she “never entered into consensual sex with this young man” and she was simply “in her house intoxicated when these people came and knocked on her door.”

    “Letting them in her house was by far her biggest mistake,” he added.

    Thus far having a daddy for a judge seems to have worked out extraordinarily well for Shelley Dufresne.
